Independent Legal Advice

Both the lawyers’ Rules of Professional Conduct (lawyers’ Rules) and the Paralegal Rules of Conduct (Paralegal Rules) outline circumstances
in which a lawyer or paralegal must recommend or require the client to obtain independent legal advice or independent legal representation. The following summarizes the situations that require independent legal advice or independent legal representation contained in each set of Rules.

UNREPRESENTED PERSONS 
 
When dealing with an unrepresented person while representing a client in a matter, both lawyers and paralegals must urge the unrepresented person to obtain independent legal representation [clause 2.04(14)(a) of the lawyers’ Rules, clause 4.05(a) of the Paralegal Rules].
